1. Information we collect
We collect information that alone or in combination could identify you or your device, as well as information that is aggregated or de-identified. Categories include:
- Account and profile. Name, email, organization, username, password or authentication tokens, billing address, tax identifiers where required, and preferences.
- Marketplace and commercial data. Listings, product or content metadata, order history, payout and tax information for sellers, customer support tickets, and dispute-related communications.
- Payment information. Payment details are typically processed by third-party payment processors; we may receive limited payment metadata (e.g., last four digits, transaction IDs).
- Content you upload or generate. Files, media, descriptions, messages, prompts, and other materials you submit to the Services, including interactions with AI features.
- Usage and device data. Log data, IP address, approximate location derived from IP, browser type, device identifiers, pages viewed, referring URLs, timestamps, and diagnostic or performance data.
- Cookies and similar technologies. As described in our cookie disclosures or consent tools where applicable.
- Communications. Information you send us by email, chat, or forms, and records of our responses.
- Information from third parties. Single sign-on providers, integrations you connect, fraud-prevention vendors, and publicly available sources, where permitted.
2. How we use information
We use information to:
- Provide, operate, secure, and improve the Services;
- Create and manage accounts, authenticate users, and process transactions;
- Facilitate marketplace operations (listings, discovery, fulfillment, payouts, and compliance checks);
- Run, tune, and monitor AI-powered features (e.g., recommendations, automation, conversational agents);
- Detect, prevent, and respond to fraud, abuse, security incidents, and illegal activity;
- Comply with legal obligations and enforce our terms;
- Communicate about the Services, including transactional messages and, where allowed, marketing (you may opt out of marketing as described in messages or account settings);
- Analyze usage in aggregate or de-identified form to develop new features and measure performance.
3. Artificial intelligence and automation
Our Services may use machine learning models and third-party AI providers to process prompts, content, and usage signals. In line with practices common among leading AI platforms:
- Processing. Inputs and outputs may be transmitted to subprocessors that host or run models, subject to our agreements and this policy.
- Human review. In limited cases (e.g., safety, quality, or legal compliance), authorized personnel may review interactions.
- Training. Unless we expressly state otherwise in product-specific terms or settings, we design flows so that customer content is not used to train third-party foundation models for their general models where contractually prohibited; your agreement and product documentation control any optional improvement programs.
- Accuracy. Automated outputs may be incorrect or incomplete; you should not rely on them as sole grounds for high-risk decisions without human oversight where appropriate.
4. Legal bases (EEA, UK, and similar regions)
Where GDPR or similar laws apply, we rely on one or more of the following:
- Contract — to perform the Services you request;
- Legitimate interests — to secure our platform, improve features, and communicate in expected ways, balanced against your rights;
- Consent — where required for cookies, marketing, or specific AI processing;
- Legal obligation — to meet tax, regulatory, or law-enforcement requirements.
5. How we share information
We may disclose information to:
- Service providers and subprocessors (hosting, analytics, payments, email delivery, customer support, fraud prevention, AI inference providers);
- Other users — when you choose to make listings public or interact in the marketplace;
- Professional advisors (lawyers, auditors) under confidentiality obligations;
- Authorities when required by law or to protect rights, safety, and security;
- Business transfers — in connection with a merger, acquisition, or asset sale, subject to appropriate safeguards.
We do not sell personal information in the conventional sense of “selling” for money; where “sale” or “sharing” is defined broadly (e.g., certain U.S. state laws), we provide choices as required.
6. International data transfers
We may process information in countries other than where you live. Where required, we use appropriate safeguards such as Standard Contractual Clauses, the UK Addendum, or other lawful transfer mechanisms, together with technical and organizational measures.
7. Retention
We retain information for as long as necessary to provide the Services, comply with law, resolve disputes, and enforce agreements. Retention periods vary by data category and may be tied to account lifecycle, legal holds, or backup cycles.
8. Security
We implement technical and organizational measures designed to protect personal information. No method of transmission or storage is completely secure; we encourage strong passwords, MFA where available, and prompt reporting of suspected compromise.
9. Purchases, billing, and refunds
When you buy a subscription or pay fees, we (and our payment processors) process billing data such as name, email, billing address, payment method tokens, transaction IDs, and plan history. We use this information to collect payment, prevent fraud, meet tax and accounting obligations, and respond to refund or chargeback requests.
How you may cancel subscriptions, exercise statutory withdrawal or cooling-off rights, and request refunds is described in our Refund and cancellation policy in the Terms of Service. Retention of payment records may be longer than for other data where the law requires.
10. Your privacy rights
Depending on your location, you may have the right to access, correct, delete, or export your personal information; object to or restrict certain processing; withdraw consent where processing is consent-based; and lodge a complaint with a supervisory authority. To exercise rights, contact us using the details below. We may verify your request as permitted by law.
11. Children
The Services are not directed to children under the age where parental consent is required in your region. We do not knowingly collect personal information from children in violation of applicable law.
12. U.S. state privacy notices
Residents of certain U.S. states may have additional rights (e.g., access, deletion, correction, opt-out of “sale”/“sharing” for cross-context behavioral advertising, appeal). We will honor applicable requests as required by law. You may designate an authorized agent where permitted.
13. Brazil (LGPD)
If you are in Brazil, you may have rights under the Lei Geral de Proteção de Dados (LGPD), Brazil’s General Data Protection Law, including confirmation of processing, access, correction, anonymization, portability, deletion, information about sharing, and revocation of consent where applicable. Our legal basis for processing may include consent, contract performance, legal obligation, credit protection, legitimate interest, health protection, or protection of life, as appropriate.
14. Changes
We may update this Privacy Policy from time to time. We will post the updated version and revise the “Last updated” date. Where required, we will provide additional notice or obtain consent.
